Nintendo has been around for almost 40 years. Today Nintendo has the Nintendo Switch out on the shelves as they release new games for it weekly, but for those that would like to play the older games there isn't much way to do so unless you have the original system from when it originally released. Thanks to technology though those people that want to play the old fashion games can with something called a ROM or Emulator. ROMs allow for players to download replicas of games onto their computers, phones or even gaming systems. ROMs are a big part of the gaming community because it also allows for fan made games to played too.
though does not like that players can easily gain access to their games through these ROMs without paying anything. Not only does Nintendo lose money on all these games that are being played for free but also it violates copyright and trademark infringement laws.
In 2018 Nintendo took legal action and sued the married couple that ran LoveROMs.com and LoveRETRO.co for copyright and trademark infringement. Both of the websites, operated by the married couple, allowed for users to download thousands of Nintendo games. The case was filed in July, 2018 but never made it to trial because both parties went into an agreement that let the court decide a final judgement and would grant a permanent injunction on the married couple.
The court decided that the couple would pay $12,230,000 to Nintendo for all damages and ordered them to remove all Nintendo products from their websites. It is unspoken about whether the couple were able to pay off the $12 million to Nintendo but if they did it means that they made millions off of their websites. Now that Nintendo has made it known that they aren't afraid to pursue legal action on the issue, at the moment no one knows that they might do next about the rest of the ROM sites across the internet.
